Terms of Service
These Terms of Service ("Terms") govern your use of swoftops.com and any services provided by Opportunity Maven LLC dba SwiftOps ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
SwiftOps provides AI operations consulting and automation services for independent insurance agencies. Our services include workflow audits, automation builds, and ongoing monthly management retainers ("Services"). The specific scope, timeline, and pricing for Services are defined in a separate written proposal or service agreement provided to each client.
2. Eligibility
Our Services are intended for businesses and business owners. By engaging SwiftOps you represent that you are authorized to enter into agreements on behalf of your agency or business.
3. Proposals and Agreements
Submitting our lead intake form does not create a binding agreement or guarantee of services. A binding engagement begins only when both parties have executed a written service agreement or proposal and applicable payment has been received. We reserve the right to decline any engagement at our discretion.
4. Payment Terms
Payment terms are specified in each individual service agreement. Generally:
- Audit + Build engagements require a deposit prior to commencement of work
- Monthly retainers are billed in advance on a recurring basis
- Minimum retainer commitment is three (3) months unless otherwise agreed in writing
- All fees are non-refundable except as explicitly stated in the service agreement
5. Deliverables and Intellectual Property
Upon full payment, you own the workflows, documentation, and automations we build specifically for your agency. We retain the right to use general methodologies, frameworks, and non-client-specific knowledge developed during engagements in future work.
We may use your agency name and general engagement outcomes as a reference or case study unless you request otherwise in writing.
6. Client Responsibilities
You agree to:
- Provide timely access to systems, credentials, and information reasonably required to perform the Services
- Designate a point of contact who can make decisions related to the engagement
- Review and provide feedback on deliverables within agreed timeframes
- Ensure you have the right to share any data or system access provided to SwiftOps
7. Confidentiality
We treat all client information as confidential and will not disclose it to third parties except as required to perform the Services or as required by law. We expect the same in return — any proprietary methods, pricing, or processes we share with you are confidential.
8. Limitation of Liability
To the maximum extent permitted by law, SwiftOps and Opportunity Maven LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our Services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from our Services shall not exceed the total fees paid by you in the three months preceding the claim.
9. No Guarantee of Results
We build and manage automation systems to the best of our ability. We do not guarantee specific business outcomes, revenue increases, or time savings. Results depend on factors including your agency's existing processes, staff adoption, and third-party platform reliability.
10. Termination
Either party may terminate a monthly retainer engagement with 30 days written notice after the initial commitment period. Termination does not entitle you to a refund of prepaid fees. We reserve the right to terminate an engagement immediately if you breach these Terms or the applicable service agreement.
11. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nevada, and you consent to personal jurisdiction in that venue.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of our website or Services after changes constitutes acceptance of the updated Terms. We will post the effective date of any updates on this page.
